Council approval

Projects that fall into the exempt development category do not require council approval. Projects such as renovating a bathroom, replacing a rotted deck, replacing verandah railing and many more projects can all be done without council permission.

Other projects, such as re-configuring the wall placement in your lounge or bedrooms, removal of structural members in your home and many more, all require the approval of the local council. This approval can be obtained directly through council or through a Private Certifier who is qualified and licensed to provide approval.

Failure to seek approval for work that requires approval is against the law and along with heavy fines, the work may need to be demolished or retrospectively submitted for approval. If you think you might just take the chance, consider that your insurance company will continue to accept your annual premium while having no legal responsibility to respond to any claim that you may have in the future. Illegal building works render your insurance policy useless.

If all of that doesn't put you off, consider the risk of injury to your family and friends should a failure in the building process cause failure of your home's structure. Some builders are so keen to take your money that they don't want to guide you through the process. Remember, it is against the law for a builder to hire your certifier. A certifier is there to check on the work of the builder and must not be engaged by the builder. A helpful builder may introduce you to a certifier for you to consider. You are free to use any certifier that you choose.
